Terms of Service

1. Acceptance of terms
By creating an account or using BERLYMA (the "Service"), you agree to these Terms of Service. If you use the Service on behalf of a company, you represent that you have authority to bind that company to these terms.
2. The service
BERLYMA provides property management software including property and tenant records, lease management, document storage, rent collection, maintenance tracking and electronic signature workflows. Features may change as the Service evolves.
3. Accounts & responsibilities
You are responsible for safeguarding your login credentials and for all activity under your account. You agree to provide accurate information and to use the Service only for lawful property management purposes.
4. Payments
Online rent payments and subscription billing are processed by Stripe. BERLYMA does not store full card numbers or bank credentials. Subscription fees, if applicable, are billed per your selected plan; trials convert only when you actively choose a plan.
5. Electronic signatures
E-signature workflows are provided through DocuSign, Inc. acting as our service provider. Envelopes are created and sent from a DocuSign account operated by BERLYMA on your behalf (you and your signers do not need a DocuSign account); BERLYMA is therefore the DocuSign “sender of record”, and each envelope is tagged with your company identifier so it remains attributable to you. Signed documents and DocuSign’s Certificate of Completion are archived to your company’s document storage in BERLYMA and remain accessible to you there; once archived, BERLYMA instructs DocuSign to purge its copy of the documents, which DocuSign completes after its standard 14-day hold. You are responsible for the content of documents you send for signature and for ensuring they comply with the laws applicable to your jurisdiction and lease agreements. Electronic signatures obtained through the Service are intended to comply with the U.S. ESIGN Act and UETA; consult a qualified professional regarding enforceability in your jurisdiction.
6. Your content
You retain ownership of the data, documents and images you upload. You grant BERLYMA a limited license to store and process this content solely to operate the Service. You are responsible for having the right to upload the content you store, including tenant-provided identification documents.
7. Acceptable use
You may not misuse the Service — including attempting to access other companies’ data, uploading unlawful content, or using the platform to discriminate against applicants or tenants in violation of fair-housing laws.
8. Disclaimer
BERLYMA is software, not a law firm, and nothing in the Service constitutes legal, tax or financial advice. Lease templates and generated documents should be reviewed by a qualified professional before use. The Service is provided "as is" without warranties of any kind.
9. Limitation of liability
To the maximum extent permitted by law, BERLYMA shall not be liable for indirect, incidental or consequential damages arising from your use of the Service.
10. Termination
You may stop using the Service at any time. We may suspend accounts that violate these terms. Upon termination you may request export of your data within a reasonable period.
11. Changes
We may update these terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
